I think it should be the other way round - FS-Developers should be charging Cessna for PC advertising and marketing their products :costumes:

In some instances, I agree with this.


For instance.. If Cessna was 'really' serious about selling these planes, and wanted a way to get their product in the front of possible customers faces for an hour at a time, several times a week, burning the Cessna image into their minds, they would start a flight sim advertising campaign, have some good models created of their product lines (like the Sky Catcher) and launch it and make it available to the public.


But this would cost them a tremendous amount of money. Thus it would be better to 'partnership' with a group or team and bring their product line into the Cessna website and Cessna aircraft dealerships, brochure locations, etc.

On the other hand, I'd like any of you to prove that FS addon developers have had any impact on Cessna's real aircraft sales. One or two planes isn't an impact either.

I've read all these threads with interest and quite frankly I can see no reason for concern. Just build it and stick two fingers skywards and say "So sue me". You know damn well they won't it would cost THEM too much. Just call their bluff.
Any UK judge would pee himself laughing as a he booted it out of court at the same time as slapping on a hefty fine for wasting the court's time.
 
strange people....I remember TWA a few years ago when asked to eliminate the TWA name from one of the existing flying restored Super Constellation...
 
Can't you just leave off the name Cessna? Just call it a "a four-seat, single-engine, high-wing fixed-wing aircraft". That describes a lot of aircraft over the past few decades and they all look quite a bit alike if you squint yor eyes and lean your head sideways.

Yes, because that's how copyright law works.
The problem you'll have then is if you've modelled a Cessna but just left the name off you're not really any better placed as they'll be able to point at all the similarities, plus if you allude to the similarity in your advertising they'd have you bang to rights. If you make it look less like a Cessna then you're back to the problem of promoting/selling a fictional aircraft.
As to a UK Judge laughing it out of court, he may or he may not, the law is on Cessna's side, but they don't have to sue you in a UK court. Also Textron the parent company has plenty deep enough pockets to risk suing and losing, can you afford to be taken to court and winning a long drawn out case?
I should probably point out, I don't think Cessna are going about this the sensible way but legally they are in the right so people should think carefully before ignoring them.

Maybe some guy who is now getting a taste for flight in FS will someday do well enough to be an aircraft purchaser and decide to buy a new Cessna. This sort of thing can go a long way to helping build brand loyalty. Ford ("first on race day") used to have a saying, "Wins on Sunday mean sales on Monday".

I should mention that most designs in America that are no longer produced are void of copyright. They 'must' be in production. This means that if you wanted to go make your own company and make a mirrored exact design of say a Piper Cub, you can! And at least 2 people/firms are, and Piper cannot do a thing about it because its no longer produced, (and piper would not wish to build anymore anyways).

So, I dont think Cessna can go after a person who models a plane that has been out of production for 10 years. Copyright and Patents are both out of date then.

Making it "Cesna" or "Cossno" or "Cassna" would be easier. ;P
 
I recently got a letter from a European aircraft maker asking if I plane on updating a previous release of one of thier planes. They were using my FS9 version already, and wish to have a FSX version. I'm gonna do it after I finish a couple of products.
So maybe all the Cessna type companies can take a lession from this...

So you can make a Cessna, just not the latest model!

Just claim it's the 2008 model, and they are now producing the 2009 version... ;)

It's certainly 'different'. You planning on a full FSX version with skinned animations? :costumes:

That's it in a nutshell Frank. I bought 2 Honda motorbikes as a direct result of watching Mike Hailwood race the factory Hondas at the w/e.

What a sad world we live in.
