City of Roseville Ca trying to tell news station to cease and desist in news report

http://www.kcra.com/news/26262235/detail.html

the City of roseville had a large mall fire back before thanksgiving,a youngman had a mental issue and started a fire and was appreanded and then it was thought a bomb was left inside..but the poloce dept had the sprinkler system shut off and would not co-operate with fire and allowed the fire to burn unchecked and then the roof caved in causing a total conflaguration..a quarter of the mall burned..doesnt sound like much but this place is the mall of america of nrthern california..its huge...well now KCRA news 3 got ahold of the radio traffic tapes and have been playing them which clearly show that the police department were not "playing nice" with the fire department and its very embarrassing to the city...and they have tried to claim the news station has violated federal law...but 3 has said they violated the stations first amendment right by trying to stop them...its going to be a big fight

Not sure about California but I think it may be a federal law that states that is something is on fire, the building belongs to the FD until the fire is out. Period.

And unless the city's radio system is encrypted/scrambled, listening to what is being broadcast over the airwaves and then replaying that radio traffic is not a violation of regulations/laws as set forth by the FCC.

Sounds like the PD fracked up and is trying to hide the blame for a multi million dollar loss.

you are right on all accounts Brian, cept in this case the "bad guy" was supposed to have had a bomb..so the PD was incharge,,,and in the opinion of many..they over reacted....which is what the fight is now....the city has also tried to go as far as the federal courts already to have a gag order put in place for the whole situation..the court proceedings abd everything to do with it...the federal judge said the the police and fire departments or public entities, and public serivices...not secret services,,therefroe they had no right to withold public information

The sad thing about the whole thing is that...

...I bet nothing has or will happen to the original purp. And no, I don't care if he was unhinged-- that's the problem currently: people do illegal things, and then are permitted to assume "victim status" after the crime versus being made into an example for all to see.

Sounds like the city is trying to cover up a mistake, not the first time something like that has happened and it won't be the last.
