Not even legal IMHO. Just because you put some clause in a license or an EULA, doesn't mean that you can take someone else's intellectual property and make it yours. There's a word for that and it is called theft. Pure and simple.

But indeed, they will never see my $$$ either.

So they still plan to just steal custom liveries and not bother crediting the artists because they "don't know your crediting preferences".

"If you do not submit your livery to ACE, we will upload all the free liveries to ACE ourselves.

- You will not be credited in the description because we don't know your crediting preferences."

So "make the livery exactly the way we want it, otherwise we are just going to take your work and edit it and not bother crediting you at all for it". Total rubbish.
 
They do make painting their aircraft a very attractive proposition I must say. I painted quite a few 707's, 727's and B-52's, but even if they bring them to MSFS, which I doubt, I'll steer well clear under these conditions.
 
PMDG also has a similar problem with repaints. I did a better cockpit paint for their 747 and they said I could not release it.
