Let me provide an example of how idiotic the state of tort law has reached in the United States!
I purchased a battery operated tow bar for my C-310R.
It is an excellent tow bar. But, it has an interesting product warning label on the rod. The label reads, "Remove Before Flight!"
No joke! A warning that I must remove my tow bar before I start the engines, taxi, and take off!
Now, I am sure the manufacturer of this tow bar looked his lawyer in the eye and exclaimed, "You're kidding me, right!"
Judges could end this nonsense immediately by simply throwing out frivolous tort lawsuits and forcing the attorney bringing the claim to court to pay all costs for the defendants, plus court costs. But, judges don't do that except in rare cases because most judges are lawyers themselves. They are part of the industry and vice tamping down the court docket, they seek to expand it.
Strange as it might sound, perhaps the best solution short term at least is to make it illegal for a sitting judge to have worked as a lawyer! Lawyers should be lawyers and judges should be judges and never the two should meet!
