Hi there,

On January 3, 2014 I discovered by mere coincidence that the library of a to me unknown European flightsimulator site called Fly Away Simulation, without my knowledge, makes available for download at least forty-three repaint files I have made.

I uploaded these files at Avsim.com, FlightSim.com, Sim-Outhouse.com and in a few cases at BritSim.com and Simviation.com only, as freeware with limited distribution. What "limited distribution" means is described in the "read me" text files included in the repaint files. One of the conditions for further distribution is that my explicit permission has to be obtained. (which really isn't hard) Uploading without this permission implies violation of copyright and therefore is illegal. I don't know if the managers of that site uploaded these repaints themselves or if other people did. Fact is that these files have been uploaded to and made available by this site without my permission.

That same January 3, 2014 I sent a polite e-mail to the managers of the particular flightsimulator site with the kind request to delete the forty-three repaints from their library. One week later I sent them as a reminder a copy of my request. So far I haven't received any reaction from these people and the repaints still haven't been deleted from their library.

This ignorance by what I consider a tiny minority outside our community has obviously spoiled my pleasure in sharing my repaints the way I did. Consequently I have stopped my repaint activities for the time being. This also means that my plans to make repaints for CalClassic's DC-6s and DC-7s, JBK's DC-4 and DC-6, and Derek Palmer's Dove and Heron have been shelved, at least for the time being. All the repaints which I released through the years will remain available through Avsim.com, FlightSim.com and in many cases also at Sim-Outhouse.com.

Hmm. Understand completely how you feel, and of course you have every right to take whatever action you wish with your own work. But doesn't this mainly punish the vast majority of simmers who respect and admire your work and abide by your readme conditions, while not really mattering much to the tiny minority who have not respected your wishes? :smile-new:
 
That is the Flight Simulation world.

We released the Navion for FSX back in November. Within a month it was on an India pirate site being shared packaged in a new installer. We did not use a installer for the package because we don't care for them.

I jokingly said to Larry and Rachael now we are finally Developers because our work has been stolen.

On a weird kind of level that is actually true. If your not worth a dam no one wants your work. If you do good work someone will exploit it.

For that reason the cell phone gauge in the Navion was released under CC non profit Licensing. I knew it would get stolen so I made it available for anyone to use anywhere.

I know that in the past that simnetwork.com has hosted numerous files owned by individuals here without there consent. When asked to remove them they are usually greeted with silence. In a few cases they joined there forums to voice there opinion and were silenced with a banning.

You have to remember once you release it to the world you lose all control over it.

Its sad that other members of our community do these things. Don't let it bother you just keep doing what you do because you enjoy it.

Mmm, I would say this doesn't punish anyone or anything except perhaps my own naivity. The repaints I uploaded throughout the years will remain available (of course) and it's quite a bunch. I suppose new ones will turn up sooner or later, but I really need to take this time-out. Better than remaining a grumpy old geezer.

Maarten I completely understand how you feel. The very same thing happened to me a few years back as, I'm sure, it has to many talented people in our hobby. You and I do it because we enjoy what we do and we choose to share it. I was not given the silent treatment. I was met with baligerance and profanity and was told essentially to "make" them stop, and I was indeed banned from the site!

I stewed for a day or 2 because I just could not understand why in the world anyone would want to steal something they could have for free just for the asking.

This is getting long so I'll end by saying try not to let something like this determine what you do for your own enjoyment, whether you share it or not. I hope you decide to continue to share your work with us, and I look forward to seeing those classic liners in your colors once again.

Hi Maarten, not so long ago I found my textures repacked with a different readme file on a site I had never heard of. I already knew my textures were available on another site, for which nobody ever asked me whether I agreed. However this site kept the original readme.
I have seen my textures uploaded to common sites by somebody I don't even know, who claims he has made these textures. Strange enough he made the same errors as I did :biggrin-new:. A bit longer ago I was warned by a member here that my textures were included in a package. I would not have known when this member had not informed me.

All things which perhaps shouldn't happen.

However I make repaints because I like to make repaints. I share them as there are people who like to have them as well. The fact that people make my work available at different locations or even attach their name to my work doesn't really bother me. I gave it away when I posted it on the internet. What people do with this gift is up to them. I expect decent behavior, but I'm realist enough to realise there are less decent people in the world.

By typing in google, I found Manfred's C-47 v2, my soundset, and Gman's repaints packaged together with an installer at a Indonesia site. Exclusive doesn't mean much in some parts of the world.

Well no biggie free stuff anyways!

I know how you feel. I think every one of my models has been uploaded to one site or another in violation of the terms and conditions. I've even had one model ( that I know of) ripped into 3DS and the mesh sold on the net. Another was taken and modified before being sold by a well known FS developer.

I also understand how you feel, that it is YOUR work, and therefore have the sole right to do what you want with it. But, as Duckie is saying I'd take it as a compliment, that it is worthy for someone to bother to do that, and if it is still freeware, no one is gaining out of you....bask in the glory!...ha ha..;)
