Netwings?

So, I am still unclear. Are we, or are we not making an effort to accumulate Netwings library? By we I mean anybody.

Several people have tried to contact the folks at Netwings, and there has been no response.

Several people have tried to contact the folks at AVHistory ( for permission to host the CFS2 1% planes specifically ) and there has been no response.

If there is no permission, there can be no hosting here.

  2. then you hopefully will have readme to find who the developer is
  3. then contact the developer of the addon and get authority to host.
There are many developers that are unavailable by any methods.

In such cases, host the file, make a notice in a readme that you would be glad to give credit for the file to the developer, except you don't know who it is or whereabouts.

The 1% files. There is nothing that could be done, if anyone wanted to host those files. Why because the value of them is NIL. THey have never sold a single 1% file, so what would a legal action provide. It would provide nothing in a court of law.

Besides, if they made nothing off the files why would they spend money to file legal actions when there were no financial damages.

I'm not saying to violate trusts with developers by any means. I'm merely saying all the whoopla I've read about copyright violations is non existent.

Rhumbaflappy... if www.addonthief.com wanted to host your new mesh on a website without your permission they could do so at will.

You would have to hire an attorney to wirte a litter to www.addonthief.com to get them to cease and desist (you would pay the attorney).

Then www.addonthief.com knows there is nothing that could be done, so they would just ignore the attorney letter.

Then you would have to spend a great deal more money to file a lawsuit.

www.addonthief.com could continue to leave your for free stuff on their website and you still could do nothing about it.

It would take four to six years in American courts for you to even get to a trial.

If your case ever got to trial at best the judge would instruct your the attorneys for both parties to settle before the suit began.

That would of course not happen, because if there are no monetary damages to you (civil court) the judge would not agree to even hear the case.

You would during pre-trial discover have to prove damages, which would be practically impossible as you offer your product for free distribution.

You would have spent your money, frustration and time getting to your day in court and you wouldn't even get it.

The best you might expect is for the judge to hear about 2 minutes of your complaint and he might order www.addonthief.com to remove your stuff from their website.

Do NOT jump your logic to conclude I favor violating copyrights. No way, I'm for that. I'm just saying there is no recourse to anyone offering anything for free.

I don't disagree with you. I've been sharing on forums like this for 10+ years, and worked with a few related sites.

It would be lousy practice to go against the wishes of developers, because you lose respect among your peers, the community and the developers.

We all know of one site where the plagerize other peoples work, repackage it and call it their own. That is really lousy, worse than stealing someones work, but going so far as to call it your own.

Nuff said, from my quarter on this one.

Hopefully, we'll hear from netwings.org soon enough and it will be an easy FTP download when permissioned properly.

If You put "CFS2 rend buy Bo Logna from Netwings", ...and added the original readme, ...that should take care of the author.

The financial issue with respect to a Netwings excursive agreement would be advertisement related.

1% stuff generates hits, ...which affect advertisement revenues (so the theory goes)

Netwings (or their advertisers) may pay AvH for the privilege.

The fact that the site is down would render that agreement moot. (although AvH may want to host with another site that is willing to enter into a similar agreement.)

As we are talking about CFS2 stuff, ...and not the current bright penny and religious touchstone of AvH, ...

I would expect AvH to spite us, ...and SOH to back them up.
 
Be aware that some members of the staff continue to work on this, trying to come up with a solution. Until that occurs, there is nothing that can be done.

As far as most debate about copyrights and eulas, I agree they are nonsense. This is a hobby, and no one is making money here.

But, we cannot have SOH host the 1% files because as a group we have accepted that we will respect the rights of file originators. This isn't a legal matter, but an ethical choice we made when we joined this forum/web community.

We have already agreed as a group that we will get permission to host files... and Bear's last post to this forum was a specific denial of hosting privileges to a member of our community for that member's website, concerning CFS3 1% files.

I also recall earlier instances of Bear refusing hosting rights for the CFS2 files. He was adamant. I can only assume Netwings got that permission.

This indicates Bear does actively control permission for these files, and we do not have permission by his silence on this matter. He has to tell us it is OK. As a community, OUR rules control this.

Perhaps a different community or website doesn't care about obtaining permission, just as some websites host "nocd" versions of CFS2's EXE file. That's THEIR rules... and I don't have a problem with it. If I don't like something there, or disagree, I don't have to go to that website.

As far as the rest of the files at Netwings, SOH does have an ethical procedure to follow...

Here's what SOH uploads require:


  • If you can't find any information in the archive that states that the files are copyrighted or restricted by the owner then you can upload them at SOH. If you have the original authors name you should contact the author via Email before you alter, add-to or use the file in another add-on and upload it. If permission is requested by the owner in a copyright or readme file then you need to ask permission before you include or alter the file and upload it as a add-on at SOH. Uuse common sense and follow copyright laws and get permission where it is asked is all we require. Please remember to give credit where it is due and don't forget the rights of the original author.

Rhumaflappy, you are so right in your comments. I think that the SOH approach is very ethical and that we should follow it. Through time I have come to the conclusion that while it is nice "to have everything" there is, it does not necessarily make you happier.
 
It is not a matter of having everything it is a matter if trying to save what we can so that we don`t have to repeat the same process over again.

What I am worried about is all the old CFS2 sights closing and we are getting no warning.One day they are there and next day they are gone so there goes more lost programs that can help improve CFS2 and we have to start over again.I am not out to take away the hard work that someone did all I want to do is to preserve that work and or information that will be lost because the sight that it was located on is no longer there.

You and me both Bob, CFS2 is my most favorite flight sim and I am frantically trying to get my hands on CFS2 stuff. And the same is true for FS8 (FS 2002), which is my second favorite. It is ironic when I you realize that I got CFS2 and FS8 after I got FS9, CFS3, Il-2 and BoB II. I only fly CFS2 and FS8.
 
You never know what you had until its gone I guess.Has any one got Cryingtoto's Seafire III? For some reason I never copied it [I thought I had all his stuff]. Now that I need it I can't find it.I keep getting info that it can be found at Netwings.Can't get into Netwings just like everyone I guess. Hope it comes back up.

I too feel that I would like to Skirt the Law when it comes to this Flight Sim ( CFS2 ). The times that I have screwed up my many versions of CFS2 ( cfs2Europe, cfs2DEI, cfs2NorthAfrica.ect ) and had to rebuild..I am still rebuilding at the present.

You have to show a sence of Integrity of one self and others...case in point..a designer of planes who only wants his planes to be used in FS2000,fs2004 because he dosen't want his designs In a " WAR Sim ".....YOU MAY ASK but if he says " NO "...you must Respect his wishes.

I have lost most of the planes that I had in my " CFS2SpainCW " ....I had many Repaints of the He51-A1 and planes that I had from the old " Simnetwork Spanish Civil War " site....the site is now a paysite and can't get them back.......a lost.
